The Allahabad High Court recently stirred headlines by issuing a warrant against District Inspector of Schools (DIOS) S Agra Dinesh Kumar due to allegations of denying childcare leave to teacher Vandana Tripathi. This development highlighted a crucial issue concerning the rights of female employees with minor children, who are eligible for Child Care Leave (CCL) under specific conditions.
According to regulations, female employees can avail themselves of CCL for up to two years during their service to care for their minor children, be it for rearing or during sickness. Tripathi’s complaint against DIOS Dinesh Kumar’s refusal to grant her this entitlement led to the court’s intervention. However, the warrant issued against DIOS Dinesh Kumar was not executed, prompting Tripathi to escalate the matter by filing a contempt petition.
In response to the contempt petition, DIOS Dinesh Kumar’s advocate, Anurag Tripathi, sought leniency from the court, citing his client’s hospitalisation due to a liver ailment. Anurag Tripathi assured the court that DIOS Dinesh Kumar had approved Tripathi’s childcare leave while undergoing medical treatment. This acknowledgement of compliance led to the court withdrawing the warrant against DIOS Dinesh Kumar.
Meanwhile, the Principal of Government Inter College Shah Ganj Agra, along with the in-charge DIOS Manvendra Singh, appeared in court to address the matter. They assured the court of DIOS Dinesh Kumar’s commitment to complying with the court’s order and expressed regret for any delays that had occurred. In light of their assurance and acknowledgement of the situation, the court accepted their apology and rejected the contempt petition.
